German metallic element band Die Apokalyptischen Reiter (roughly, "Horsemen of the Apocalypse") formed in mid-1995. Comprising frontman Fuchs, guitarist Pitrone, bassist Volk-Man, keyboardist Dr. Pest, and drummer Sir G., the group recorded its first base demonstration tape, Firestorm, the next yr, resulting in a deal with the Hammerheart pronounce to spillage an expanded edition highborn Soft and Stronger. NY judge: Film can use Lennon song

NEW YORK - Yoko Ono lost her legal bid today to stop the playing of a 15-second excerpt of John Lennon’s song "Imagine" in a film challenging the theory of evolution.
Lennon’s widow had sued the makers of "Expelled: No Intelligence Allowed," saying they used the ex-Beatle’s anthem without her permission.
U.S. District Judge Sidney Stein ruled that the filmmakers are protected under the fair use doctrine.



The plaintiffs, including Ono and Lennon’s sons, Sean and Julian, "have not shown a clear likelihood of success on the merits because ... defendants are likely to prevail on their affirmative defense of fair use," Stein wrote in his decision in Manhattan federal court. "That doctrine provides that the fair use of a copyrighted work for the purposes of criticism and commentary is not an infringement of copyright."
Attorneys from both sides did not immediately return calls for comment.
The movie, which opened on U.S. screens in April and is set for release in Canada on Friday and on DVD in October, presents a sympathetic view of intelligent design, the theory that the universe is too complex to be explained by evolution alone.
At a hearing last month, the filmmakers’ lawyer, Anthony T. Falzone, said that if the judge granted Ono’s request for an injunction against the film, it would "muzzle" the filmmakers’ free-speech rights.
Falzone said the segment of the song in the film — "nothing to kill or die for, and no religion too" — was central to the movie because "it represents the most popular and persuasive embodiment of this viewpoint that the world is better off without religion."
The film, he said, is "asking if John Lennon was right and it’s concluding he was wrong."
Ono countered by saying, "One of the most basic rights I control by reviewing and choosing licenses is the right to say ’no.’ The filmmakers simply looted me of the ability to do so."
The film features Ben Stein (no relation to the judge), an actor and former speech writer for Presidents Nixon and Ford, defending intelligent design.
The defendants were Premise Media Corp. of Dallas, Rampant Films of Sherman Oaks, Calif., and Rocky Mountain Pictures Inc. of Salt Lake City.

Loni Anderson - Anderson Weds For Fourth Time

Ageing pin-up LONI ANDERSON has married folk singer BOB FLICK.

The 62-year-old WKRP In Cincinnati star exchanged nuptials with The Brothers Four singer Flick in a ceremony on Saturday night (17May08), which was attended by friends and family.

Anderson was given away by her son Quinton, from her former marriage to actor Burt Reynolds, which ended in divorce in 1993.

The couple originally dated for six months when Anderson was a teenage model, but they split and went their separate ways as her acting career took off.

It is the fourth marriage for Anderson, who has decided to keep her maiden name.

She has also previously been wed to Ross Bickell and Bruce Hasselbeck.

Hospital bug payout for Leslie Ash

Actress Leslie Ash has won over €6.5 million in compensation after she contracted the superbug MRSA in an NHS hospital in London.
The 'Men Behaving Badly' star was left seriously injured after catching the bug at the Chelsea and Westminster hospital in central London.
Her lawyer, Janice Gardner said the actress was "delighted" with the payout.
Ms Gardner said the actress was pleased she would not have to go to court to fight the claim. The case was due before a judge in April before the sides reached a settlement.
She said: "I think she is delighted that we could reach an amicable settlement. Nobody really wants to go to court. It would have been hard going for her.
"In a case when you have got serious injuries you have to be reasonably satisfied that the injuries have settled before you can settle the claim."
Ash, 47, who now walks with a stick, was admitted to hospital after suffering two cracked ribs.
The payment includes compensation for money the actress would have earned had she been able to carry on working.

The calling of San Francisco dark metallers Weakling remains shrouded in mystery and local legend, partly the resultant of their possess efforts. Some of what is known is that they formed in the late '90s and consisted of singer John Gossard, guitarist Josh Smith (better known as a member of the (Ass) Champs), keyboardist Casey Ward, bassist Sarah Weiner, and drummer "Small Sunshine." The band's sole recording, Dead As Dreams, barely even came out, as the original plan had been to only release one copy of the album and give it to a stripling in Europe. (In that respect were besides plans to bury copies of the album and and then give customers maps so that they could attack to find oneself and dig up the album for themselves.) In addition, the band did not duty tour, and by the time Dead As Dreams did come out -- which it did in 2000, to surprising hail in parts of the metallic element metro and on the fringes of the indie careen globe -- the band had already busted up. After their dissolution, Weakling's members stayed busy with a kind of unlike projects -- Smith with the Champs, Gossard with the barbarian metallic element band the Gault, Little Sunshine with death/black metallers Sangre Amado, and Ward with the Kill Rock Stars band the Lies.






Mariah Carey plans to marry again next year

Mariah Carey and Ellen DeGeneresMariah Carey says she plans to marry new husband Nick Cannon again next year — but it won’t be so hush hush.


“Instead of trying to be like, ‘you’re invited, but, shhh, don’t tell anybody,’ we’re just going to have another [wedding] next year,” Carey told Ellen DeGeneres on her talk show Tuesday. “[Nick’s] plan is to have one every year.”


Those who attended her top-secret ceremony last month were “mainly people there to do my hair and help me with the dress.” The happy couple only brought along three friends each because, “we wanted to be on the beach and we didn�t want other people taking pictures,” said Carey.

Nadine Coyle buys Mexican restaurant

Nadine Coyle has bought a Mexican restaurant in California, according to reports.
The Girls Aloud singer is said to have bought the eatery in Newport Beach, the setting for popular US TV show 'The OC'.
According to The Mirror newspaper, she was busy finalising the deal when she missed last month's Brit Awards.
Coyle, whose family recently moved to nearby Santa Monica to open an Irish pub, said: "LA is my home now and the UK is where I work. I don't see the UK as home anymore because all my family are in the States."
The Derry-born singer and Hollywood star Josh Hartnett were recently the subject of rumours after they were spotted together several times last week.

Grey's Anatomy star joins Aniston in comedy

'Grey's Anatomy' star Eric Dane, who plays 'Dr McSteamy' in the show, will co-star alongside Jennifer Aniston, Owen Wilson and Alan Arkin in the new comedy 'Marley & Me'.
Wilson plays an ambitious reporter who gets a job in a newspaper and moves to Miami with his wife, played by Aniston.
According to Variety, Dane will play the journalist's best friend, who suggests that the reporter adopt a puppy as a substitute for the children his wife wants to have.
Marley morphs from an adorable little puppy into an enormous handful.
The film, an adaptation of John Grogan's bestselling memoir, will be directed by 'The Devil Wears Prada's David Franklin when shooting begins later this month in Miami.
